These Terms & Conditions of Use are a part of and governed by the Participation Agreement between you ("Customer") and Low-Est.com.

Low-Est.com's Conditions of Use:

1. Use of this site for pricing is conditioned on Customer submitting the order for materials through Low-Est.com.

2. The pricing obtained herein is proprietary information and is not to be used outside of this site.

3. Low-Est.com is not responsible or liable for Supplier pricing. It is the Customer's responsibility to verify that the pricing is accurate from the salesperson. Each sales representative is responsible for updating their master material price list on the site every thirty (30) days and/or whenever there is a material price change.

4. It is the Customer's responsibility to verify their products and quantities prior to bidding or ordering.

The failure of Low-Est.com to enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service apply to you and may not be transferred, assigned or delegated to anyone without the express written permission of Low-Est.com. Any attempt by you to assign, transfer or delegate these Terms of Service without the express written permission of Low-Est.com shall be null and void. These Terms of Service shall be governed by the law, without regard to its conflicts of law provisions. These Terms of Service comprise the entire agreement between you and Low-Est.com with respect to the use of the Service and supersedes all prior agreements between the parties regarding the subject matter contained herein (including any prior versions of the Terms of Service).
